TERMS OF SERVICE

These are the Terms and Conditions subject to which we allow you to hire our equipment. By accepting a quote and making payment you therefore agree to the outlined Terms and Conditions.

1.  The Basic Contract

1.1    This is a Hire Agreement. Sleeping Beauties owns the equipment and hire it to you (the Hirer) for the hire period, for a charge. 
1.2    The quotation is an invitation to hire. Neither party are bound to this legal agreement until the Hirer accepts the quotation and pays the subsequent deposit.
1.3    Risk of the equipment passes immediately to you when the equipment leaves our possession. That means you are responsible for taking care of it. You remain responsible for it until the equipment is safely back in our possession.

2.    Charges and Deposit: Payment Procedure
2.1   Sleeping Beauties requires an upfront, non-refundable 50% deposit at the time of booking. The remaining balance is due no later than seven days before the event. Direct credit and credit card options are available. Please contact us if there is an issue paying by the due date.
2.2    If the Hirer needs to change the date of their reservation, a minimum of seven days’ notice must be given. Hirer requests will be granted provided that the preferred date is available.
2.3    Bond payment: Sleeping Beauties may require a bond to ensure the Hirer abides to their obligations under this agreement, which will be refunded when this agreement is finished, and terms have been met.  
2.4    Delivery, assembly, styling and pickup are included in the price. Once the event is set up, the items may not be moved or disassembled.
2.5    A travel charge for set up and dismantle of $1.00 per kilometre will be charged if your venue is over 15 kilometres from our location (432 Fraser Road, RD1 Winton). Any location over one hour driving distance will be charged $1.50 per kilometre. Please note; petrol, wages, vehicle and trailer maintenance costs need to be covered.

3.     Cancellation
3.1    The cancellation of a reservation, or part of, must be made in writing seven days prior to the scheduled date. 
Sleeping Beauties will not refund any cancellations, events must be rescheduled. You have one year from the cancelled date to rebook. 
3.2   Exceptions may be considered if late cancellation is due to sickness or weather (Glamping, Outdoor Movie Package and Picnic Setup) no refund still applies. You must reschedule within a year. If the booking has already been set up and someone falls sick, you will need to rebook and pay to have it set up at an alternative date.
3.3   If you need to rebook your reservation, a minimum of seven days' notice must be given. Your request will be granted provided  the preferred date is available. 
3.4   If the Hirer wishes to cancel a booking due to bad weather conditions BUT Sleeping Beauties deem the weather forecast to be satisfactory to the conditions of the equipment then the Hirer will be accountable to the cancellation policy. If Sleeping Beauties advises the Hirer of bad weather which has the likelihood of causing damage to the equipment, the Hirer has the option to transfer dates up to 12 months from the scheduled booking. 

4.   Hirer’s Other Obligations
The hirer agrees that they will:
4.1   Take care of Sleeping Beauties' property and supervise their guests around the equipment.
4.2   Use the equipment only in accordance with Sleeping Beauties' instructions.
4.3   Return the equipment to Sleeping Beauties in the condition in which it was delivered.
4.4   Do not attempt to repair or service the equipment before first consulting with Sleeping Beauties.
4.5   Only use the heaters, power cords, adapters, and petrol for the generator, provided by Sleeping Beauties. 
4.6   Strictly NO PETS are permitted on Sleeping Beauties' property. If animals are sighted or pet hair is found on our equipment, a cleaning fee will be charged.
4.7   Sleeping Beauties asks that no makeup, nail polish, craft supplies, or similar, be inside or around the euipment at any time. Replacement charges for any damaged items WILL apply.
4.8   All events must be held in smoke-free environments. 
4.9   Sleeping Beauties' staff members will need to park as close to your set up area as possible, therefore, clear access is required at time of arrival and departure. 
4.10  Sleeping Beauties requires that the designated event area be clean and cleared.
4.11   Please make sure that there is enough clear room to set up your booked item. Please check with us if you are unsure on what space is required.

5. SoftPlay/Bounce Castle Rules

5.1 You MUST NOT wear shoes, socks on is ideal. Ages 5 and under only. NO high heels on mats, NO food or drinks allowed, NO face paint, paint of any sort, glitter or slime. NO dirt or sharp objects. Balls MUST remain in the Ballpit. It is a timely job collecting the balls upon pick up, so having them in the pit saves a lot of time. It is also a safety procedure to have the balls enclosed.

5.2 Adult supervision is required at ALL times.

5.3 A backup, inside venue is always recommended. This gear cannot get wet or damp, or it will cause mould, swelling and severe damage. 

5.4 Bouncy castles, if outside, must stay pegged down at all times. No climbing over the walls is allowed or playing with the off/ on switch. 

5.5 If the wind begins to pick up, it is essential that the Bounce House is to be deflated. This is to secure the safety of everyone around it.

6.     Loss or Damage 
6.1    The Hirer must inform Sleeping Beauties immediately if any of the equipment is damaged or stolen.
6.2    If the equipment is stolen the Hirer agrees to co-operate with the police as far as their help is required.

7.     Miscellaneous 
7.1    No amendment or variation to this Agreement is valid unless in writing and signed by both parties.
7.2   The parties agree that electronic communications satisfy any legal requirement that such communications be in writing.
7.3    In the event of a dispute between the parties to this Agreement, then they undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.
7.4    The validity, construction and performance of this Agreement shall be governed by the laws of New Zealand.
